MarketingHero develops and provides MarketingHero GPT, a custom AI solution designed for your business needs. To use MarketingHero GPT, you must have an active, paid subscription to OpenAI’s ChatGPT (Plus, Team, or Enterprise). We do not provide access to OpenAI’s services directly.

Eligibility

To use our Service, you must:

Fees and Payments

MarketingHero GPT is offered as a paid service, with pricing determined during the engagement process.All payments are non-refundable unless explicitly stated otherwise. You are responsible for maintaining an active OpenAI subscription, as our Service relies on OpenAI’s platform.

Permitted Use and Restrictions

By using MarketingHero GPT, you agree NOT to:

Intellectual Property

MarketingHero GPT is developed by MarketingHero, and we retain ownership of proprietary methodologies, configurations, and tools used in its creation. You are granted a non-exclusive, non-transferable license to use MarketingHero GPT for your business or personal use.

Limitation of Liability

MarketingHero is not responsible for any direct, indirect, or incidental damages resulting from the use of MarketingHero GPT. Since our service relies on OpenAI’s ChatGPT platform, we are not liable for any limitations, outages, or policy changes imposed by OpenAI.

Privacy & Data Usage

We do not collect, store, or share your chat conversations processed through MarketingHero GPT. Please refer to our Privacy Policy for further details.

Termination of Service

We reserve the right to suspend or terminate access to MarketingHero GPT if you violate these terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington. Any disputes will be resolved under these laws.
